What stopped Andhra Pradesh’s 34% BC quota in local bodies? | Explained

What stopped Andhra Pradesh’s 34% BC quota in local bodies? | Explained

Posted on October 15, 2026 By admin

The story so far: The controversy over enhanced reservations for Backward Classes (BCs) in Andhra Pradesh’s local body elections highlights the challenge of turning electoral promises into legally sustainable policies. The N. Chandrababu Naidu-led NDA government sought to raise BC reservations to 34% in rural local bodies and 33.33% in urban local bodies, to fulfil a key commitment made during the 2024 elections. But the initiative suffered a setback after the Andhra Pradesh High Court struck down the government orders on October 1, 2026. The Supreme Court subsequently dismissed the State government’s appeal on October 9, 2026, upholding the High Court’s judgment.

The dispute centres on three issues: the 50% ceiling on aggregate vertical reservations, the Supreme Court’s triple-test requirements for BC reservations in local bodies, and the government’s alternative strategy of allocating more election tickets to BC candidates.

Why did the enhanced quota face a legal hurdle?

The government intended to increase BC representation in grassroots democratic institutions. But reservations for Scheduled Castes (SCs), Scheduled Tribes (STs) and BCs fall under vertical reservations, which are subject to the judicially established 50% ceiling in local body elections.

By increasing the BC quota to 34%, the government risked pushing aggregate reservations beyond the permissible ceiling when combined with existing SC and ST quotas.

The High Court struck down the orders, holding that the enhanced reservation could not be implemented without complying with constitutional and judicial requirements. The ruling did not eliminate the need to improve BC representation; it restricted the method adopted to achieve that objective.

What is the triple test?

The Supreme Court has prescribed a three-part framework, commonly known as the triple test, for determining BC reservations in local body elections.

First, the State must establish a dedicated commission to conduct a rigorous empirical inquiry into the nature and implications of political backwardness among BCs.

Second, the commission must determine the appropriate proportion of reservation for individual local bodies based on its findings. A uniform percentage cannot simply be imposed across the State without the required assessment.

Third, total reservations for SCs, STs and BCs must remain within the 50% ceiling, subject to applicable constitutional exceptions.

These requirements ensure that enhanced reservations are supported by specific evidence and comply with the legal framework governing political representation.

Why was the Unified Family Survey insufficient?

The Andhra Pradesh government relied on data from the Unified Family Survey to support its decision to enhance BC reservations. But the courts held that general household data could not replace the specialised empirical investigation required under the triple test.

A household survey may provide information about population and socioeconomic conditions, but political reservation requires a focused assessment of backwardness and representation at the local body level.

The objection concerned whether the information satisfied the evidentiary requirements laid down by the Supreme Court. The judicial setback left the government unable to implement the enhanced quotas through the invalidated orders.

How are women’s reservations different?

Vertical reservations cover categories such as SCs, STs and BCs. Horizontal reservations, including those for women, operate across these categories rather than creating an additional independent vertical quota.

Consequently, women’s reservations of 33% or 50%, wherever prescribed by applicable law, operate within the relevant reservation framework. They are legally distinct from the aggregate ceiling governing vertical reservations.

BC-E, which includes designated socially and educationally backward Muslim groups in Andhra Pradesh, also falls within the vertical reservation framework where the groups concerned are classified under the BC category. Such reservations remain subject to applicable aggregate ceilings and classification rules; they do not constitute a blanket reservation for all Muslims on religious grounds.

What is the political impact?

Reacting sharply to the courts’ verdicts, Mr. Naidu and NDA leaders blamed the YSR Congress Party (YSRCP) for obstructing the empowerment of the backward classes and accused it of being anti-BC.

Mr. Naidu said: “Backward castes are the backbone of the State and they constitute over 50% of the population. But YSRCP is obstructing their development by creating legal hurdles.” He said the lives of over 16,000 candidates were now in jeopardy.

For the YSRCP, the court ruling offers an opportunity to question the NDA government’s legal preparedness and portray the failure of the enhanced quota as an unfulfilled electoral commitment. The party can argue that BC communities have been denied the intended statutory protection despite the government’s promise, while demanding a legally sustainable mechanism. Its political advantage, however, will depend on the credibility of its position and its ability to offer a workable alternative.

Following the judicial setback, the ruling NDA coalition announced that it would voluntarily allocate 34% to 40% of its election tickets to BC candidates, including in unreserved general seats.

Political parties can nominate BC candidates in general-category seats without those seats being legally reserved for a particular community. The strategy seeks to increase BC representation without relying exclusively on statutory reservations.

YSRCP president Y.S. Jagan Mohan Reddy has criticised the government over the setback, arguing that the original orders were legally flawed and that the promise of enhanced statutory reservations remains unfulfilled.

The ruling coalition, meanwhile, presents its proposed ticket allocation as evidence of its continued commitment to BC representation.

For the TDP, the Jana Sena and the BJP, the strategy offers an opportunity to strengthen their appeal among BC voters by giving local leaders greater opportunities to contest elections. But political gains will depend on whether the promised allocation translates into meaningful representation and whether BC voters consider it a credible alternative to legally guaranteed reservations. The YSRCP could counter that voluntary nominations cannot provide the certainty of a statutory quota.

What lies ahead?

Voluntary ticket allocation may improve opportunities for BC candidates, but it does not provide the same statutory guarantee as legally enforceable reservations.

For enhanced BC reservations to withstand judicial scrutiny, the government must satisfy the triple-test requirements, establish the necessary empirical basis and comply with the aggregate ceiling.

Andhra Pradesh must expand BC representation while ensuring that affirmative action policies remain constitutionally sustainable. The outcome will depend on how effectively the government reconciles its political commitments with the legal safeguards governing local democracy.
