Kerala HC to consider plea challenging ACS order restructuring police associations and dissolving KPOA

A petition by the Kerala Police Association (KPA) before the Kerala High Court, aggrieved by an order of the Additional Chief Secretary (Home) to re-organise the association and dissolve the Kerala Police Officers Association (KPOA), is set to be considered by the Single Bench of Justice Bechu Kurian Thomas on Thursday (July 30, 2026).

The KPA challenged the reorganisation order, citing that it violated its fundamental right to form associations under the Constitution of India. It was also contended that the Additional Chief Secretary was unauthorised to pass the order, as the Centre was vested with the power to modify any rights conferred on a citizen who is part of the forces charged with maintaining public order.

The abolished KPOA had been in operation for 47 years. The order directed that its bank accounts, documents, deposits, investments and all rights shall be distributed – 60% to the Kerala Police Association and 40% to the Kerala Police Senior Officers Association.

The petitioner pointed out that the impugned order was “totally silent” about the reasoning behind the restructure.
