Three men sentenced to jail in separate cases of raping, abducting, and harassing minor girl

The Additional District and Sessions (Special POCSO) Fast Track Special Court-1 in Kalaburagi on Friday delivered three judgments against three individuals for the sexual abuse of a minor.

Judge S.L. Chavan sentenced the primary accused, 30-year-old Nagesh alias Babu alias Babya, a mason by profession and resident of Mahadeva Nagar in Kalaburagi, to 25 years of rigorous imprisonment for abducting and repeatedly raping the 12-year-old girl.

In the other two judgments, the court sentenced 20-year-old construction worker Shivaraj alias Surajya to three years of imprisonment for sexual harassment and blackmail, and 19-year-old auto-driver Mallikarjun Mallu to three years of imprisonment for abduction and wrongful confinement.

According to the prosecution, in 2025 Nagesh stalked the victim and abducted her. He repeatedly raped the girl thrice, March 22, April 1, and April 8. Nagesh also threatened the victim to keep quiet about the incident.

On April 6, Shivaraj began blackmailing her and sexually assaulted her at his residence and also warned her of dire consequences if she spoke out.

On April 11, Mallikarjun forcefully took the minor to his house and confined her. On April 12, he took the girl to a house in Dharmapur. The next day, the victim’s parents tracked them and brought them back. and also reported the matter to the police.

Delivering the quantum of punishment for Nagesh, Justice Chavan sentenced him to 25 years of rigorous imprisonment and imposed a fine of ₹25,000 under Section 6 of the POCSO Act. He was also sentenced under Section 12 of the POCSO Act to two years of imprisonment with a fine of ₹10,000, and under BNS Sections 127(2) and 351(2) to six months and one year of imprisonment respectively, along with a fine of ₹5,000 for each BNS offence, bringing his total fine to ₹45,000.

Shivaraj was sentenced under Section 8 of the POCSO Act to three years of imprisonment and a fine of ₹50,000, alongside a six-month sentence and a ₹5,000 fine under BNS Section 127(2). Mallikarjun Mallu was sentenced under BNS Section 137(2) (kidnapping) to three years of imprisonment and a fine of ₹50,000, and under BNS Section 127(2) (wrongful confinement) to six months of imprisonment and a fine of ₹5,000.

The court directed the District Legal Services Authority to disburse a compensation of ₹5,00,000 in connection with Nagesh’s case, ₹50,000 for Mallikarjun’s case, and ₹50,000 in Shivaraj’s case, bringing the cumulative rehabilitation compensation to ₹6,00,000. The judge ordered that this financial assistance must be handed over to the survivor within one month of the judgment.
