The Italian coast guard said on Thursday the body of British tech magnate Mike Lynch is among those recovered off the coast of Sicily from the wreckage of a superyacht whose builders had called unsinkable.

One woman remains missing. She has not been identified, but Hannah Lynch, Lynch’s 18-year-old daughter, is reportedly unaccounted for. The family had been celebrating his recent acquittal on fraud charges with the people who defended him at trial in the United States.

Five others were recovered by rescue crews following on Monday’s tragedy.

The Bayesian, a 56-meter (184-foot) British-flagged yacht, went down in a storm early on Monday as it was moored about a kilometer (half a mile) offshore. Civil protection officials said they believe the ship was struck by a tornado over the water, known as a waterspout, and sank quickly.

Termini Imerese Public Prosecutor’s Office investigators were collecting evidence for a criminal investigation, which they opened immediately after the tragedy despite no formal suspects having been publicly identified.

The chief executive of The Italian Sea Group, which owns the Bayesian’s manufacturer, told AP in an interview on Thursday that superyachts like these are “designed to be unsinkable.”

“And it is unsinkable not only because it is designed in this way, but also because it is a sailing ship and sailing ships are the safest ever,” CEO Giovanni Costantino said.

Costantino added that “obviously they must not hit the rocks violently, discarding the hull, and they must not take in water,” suggesting the second possibility was the most likely in this case.

Costantino also noted that sailing ships require “a greater competence” to be guided compared with motor boats.

Investigators are now looking at why the Bayesian, built in 2008 by Italian shipyard Perini Navi, sank while a nearby sailboat remained largely unscathed. Fifteen of the 22 people aboard survived by escaping in a lifeboat, including a mother who reported holding her 1-year-old baby over the waves to save her. They were rescued by the sailboat Sir Robert Baden Powell.

The sailboat’s captain, Karsten Borner, said his craft sustained minimal damage — the frame of a sun awning broke — even with winds that he estimated had reached 12 on the Beaufort wind scale, the highest hurricane-strength force on the scale.

He said he had remained anchored with his engines running to try to maintain the ship’s position as the forecast storm rolled in.

“Another possibility is to heave anchor before the storm and to run downwind at open sea,” Borner said in a text message. But he said that might not have been possible for the Bayesian, given its 75-meter (246-foot) tall mast.

“If there was a stability problem, caused by the extremely tall mast, it would not have been better at open sea,” he said.

Yachts like the Bayesian are required to have watertight compartments that are specifically designed to prevent a rapid, catastrophic sinking even when some parts fill with water.

Lynch is the only person confirmed dead; the other bodies have not been formally identified by the Italian coast guard.

Besides Hannah Lynch, those missing are Christopher Morvillo, one of Lynch’s U.S. lawyers, and his wife, Neda; Jonathan Bloomer, chairman of Morgan Stanley’s London-based investment banking subsidiary, and his wife, Judy.

The body of chef Recaldo Thomas was the first to be recovered, on Monday. His death was confirmed by his family.

Divers have struggled to find the bodies in the yacht’s hull on the seabed 50 meters (164 feet) underwater.

“We would need a crystal ball to know when we’ll be able to find the next body,” said Luca Cari, spokesperson for the fire rescue service.

“It’s very difficult to move inside the wreckage. Moving just one meter can take up to 24 hours,” Cari said.

Divers searching the wreck of a superyacht that sank off Sicily found the bodies of five passengers on Wednesday and searched for one more as questions intensified about why the vessel sank so quickly when a nearby sailboat remained largely unscathed.

Rescue crews brought four body bags ashore into port at Porticello. Salvatore Cocina, head of the Sicily civil protection agency, said a fifth body had been located. Divers at the scene said they would try to recover it on Thursday while continuing the search for the sixth.

The discovery made clear the operation to search the hull on the seabed 50 meters (164 feet) underwater had quickly turned into a recovery one, not a rescue, given the amount of time that had passed and with no signs of life emerging over three days of searching.

Fifteen people escaped in a lifeboat and were rescued by a nearby sailboat. One body was recovered on Monday — that of the ship’s chef, Recaldo Thomas, of Antigua.

Thomas was born in Canada, according to his cousin David Isaac, but would visit his parents’ homeland of Antigua as a child, moving permanently to the tiny eastern Caribbean island in his early 20s. Italian officials previously listed Antigua and Canada as the nationality of people on board.

The fate of six missing passengers had driven the search effort, including British tech magnate Mike Lynch, his 18-year-old daughter and associates who had successfully defended him in a recent U.S. federal fraud trial.

Lynch’s spokesperson did not respond to a request for comment Wednesday.

Meanwhile, investigators from the Termini Imerese Public Prosecutor’s Office were acquiring evidence for their criminal investigation, which they opened immediately after the tragedy even though no formal suspects have been publicly identified.

Questions have abounded about what caused the superyacht, built in 2008 by Italian shipyard Perini Navi, to sink so quickly, when the nearby Sir Robert Baden Powell sailboat was largely spared and managed to rescue the survivors.

Giovanni Costantino, head of The Italian Sea Group, which owns the shipmaker, blamed human error for the disaster, which he said took 16 minutes. “The ship sank because it took on water. From where, the investigators will say,” he told RAI state television after he met with prosecutors.

Costantino cited AIS ship tracking data which he said showed the Bayesian had taken on water for four minutes when a sudden gust of wind flipped it and it continued taking on water. The ship straightened up slightly and then went down, he said.

But was it merely the case of a freak waterspout that knocked the ship to its side and allowed water to pour in through open hatches? What was the position of the keel, which on a large sailboat like the Bayesian might have been retractable, to allow it to enter shallower ports?

“There’s a lot of uncertainty as to whether it had a lifting keel and whether it might have been up,” said Jean-Baptiste Souppez, a fellow of the Royal Institute of Naval Architects and the editor of the Journal of Sailing Technology. “But if it had, then that would reduce the amount of stability that the vessel had, and therefore made it easier for it to roll over on its side,” he said in an interview.

“So for the vessel to sink, especially this fast, you are really looking at taking water on board very quickly, but also in a number of locations along the length of the vessel, which again indicates that it might have been rolled over on its side,” Souppez said.

Italian coast guard and fire rescue divers continued the underwater search in dangerous and time-consuming conditions. Because of the wreck’s depth, which requires special precautions, divers working in tag teams could only spend about 12 minutes at a time searching, though reinforcements outfitted with special equipment to enable longer dives were also on the wreck Wednesday.

In all, some 27 divers were taking rotations, including four who helped with the recovery of the 2012 Costa Concordia disaster off Tuscany. They called the Porticello wreck a “little Concordia,” fire crews said in a statement, which for the first time on Wednesday referred to the operation as a “recovery.”

The limited dive time was designed in part to avoid decompression sickness, also known as the “bends,” which can occur when divers stay underwater for long periods and ascend too quickly, allowing nitrogen gas dissolved in the blood to form bubbles.

“The longer you stay, the slower your ascent has to be,” said Simon Rogerson, the editor of SCUBA magazine. He said the tight turnaround time suggested the operation’s managers were trying to limit the risks and recovery time after each dive.

“It sounds like they’re operating essentially on no decompression or very tight decompression, or they’re being extremely conservative,” he said.

Additionally, the divers were working in extremely tight spaces, with debris floating around them, limited visibility and air tanks on their backs.

“We are trying to advance in tight spaces, but any single thing slows us down,” said Luca Cari, spokesman for the fire rescue service. “An electric panel could set us back for five hours. These aren’t normal conditions. We’re at the limit of possibility.”

“It’s not a question of entering the cabin to inspect it,” he added. “They’ve arrived at the level of the cabins, but it’s not like you can open the door.”

Scuba divers scouring the wreck of British tech magnate Mike Lynch’s family yacht, which sank off Sicily two days ago, have found two bodies inside it, a source close to rescue operations said on Wednesday.

One of the bodies belonged to a heavily built man, the source said.

Rescue officials have been looking for six missing people, including Lynch, his 18-year-old daughter and Jonathan Bloomer, a non-executive chair of Morgan Stanley International.

The British-flagged Bayesian, a 56-metre-long (184-ft) superyacht, was carrying 22 people, and was anchored off the port of Porticello, near Palermo, when it capsized during a fierce storm on Monday.

Fifteen people survived, while the body of the onboard chef, Canadian-Antiguan national Recaldo Thomas, was found near the wreck hours after the disaster.

Inspection of the wreck, lying sideways at a depth of around 50 metres, was a “long and complex” operation, the Italian fire department said, with inside spaces obstructed by furniture and debris, and scuba divers having just 8-10 minutes beneath the water before needing to resurface.

Separately, the coast guard deployed a remotely operated vehicle to scan the seabed and take underwater pictures and videos that it said may provide “useful and timely elements” for prosecutors looking into the disaster.

The coast guard has been questioning survivors, including the captain of the Bayesian, and passengers on the yacht that was moored next to it who witnessed the ship going down, judicial sources said.

No one is under investigation at the moment, sources added.

MISSING PASSENGERS

Lynch, 59, is one of the UK’s best-known tech entrepreneurs and has been referred to as the country’s Bill Gates.

He built the UK’s largest software firm, Autonomy, which was sold to HP for $11 billion in 2011, after which the deal spectacularly unravelled with the U.S. tech giant accusing him of fraud, resulting in a lengthy trial. Lynch was acquitted on all charges by a jury in San Francisco in June.

The other missing passengers were Bloomer’s wife Judy, Clifford Chance lawyer Chris Morvillo and his wife, Neda Morvillo. Morvillo represented Lynch in the San Francisco trial, while Bloomer was a character witness on his behalf.

Experts have been at a loss to explain how a large luxury vessel, presumed to have top-class fittings and safety features, could have sunk within minutes, as recounted by witnesses. The yacht anchored next to it was unharmed by the tempest.

The Bayesian, which was owned by Lynch’s wife, was built by Italian shipbuilder Perini in 2008 and last refitted in 2020. It had the world’s tallest aluminium mast, measuring 72 metres, according to its makers.

BLACK SWAN EVENT

Its captain James Cutfield, a 51-year-old New Zealander who survived the shipwreck, was a “very good sailor” and “very well respected” in the Mediterranean, his brother Mark told The New Zealand Herald.

Matthew Schanck, chair of the Maritime Search and Rescue Council, a UK-based non-profit organisation that trains sea rescuers, said the Bayesian was the victim of a “high impact” weather-related incident.

“If it was a water spout, which it appears to be, it’s what I would class as like a ‘black swan’ event,” he told Reuters, referring to a rare and unpredictable phenomenon.

He said he was confident the authorities would “get to the bottom” of what caused the shipwreck, thanks to the accounts of survivors, witnesses and examination of the sunken hull, which did not show any apparent signs of damage.

Divers resumed a search on Wednesday (August 21) for survivors after British tech entrepreneur Mike Lynch’s yacht sank off the coast of Sicily two days ago, though hopes dwindled of finding the six missing people alive.

The British-flagged Bayesian, a 56-metre-long (184-ft) superyacht, was carrying 22 people and was anchored off the port of Porticello, near Palermo, when it capsized during a fierce storm on Monday.

Fifteen people survived, one crew member’s body was recovered and six passengers remain unaccounted for, including Lynch, his 18-year-old daughter and Jonathan Bloomer, a non-executive chair of Morgan Stanley International.

Underwater inspection of the wreck resumed early on Wednesday after being paused late on Tuesday, the fire department said on social media. It earlier described the operations as “long and complex”.

The yacht was lying sideways at a depth of around 50 metres, giving divers 8-10 minutes to inspect it before having to resurface. Efforts have been hampered by “very confined” spaces inside the wreck, fire department spokesman Luca Cari said.

A superyacht that sank Monday off the Sicilian coast during a storm left six passengers missing, including British tech kingpin Mike Lynch and some of his inner circle, who were gathered to celebrate his victory in a long-running legal trial.

Here’s a look at the people who remain missing following the disaster, and also details of the death of an associate of Lynch in recent days who was not on the yacht.

Lynch had been trying to move past a Silicon Valley debacle that had tarnished his legacy as an icon of British ingenuity.

A Cambridge-educated mathematician, Lynch made his mark with Autonomy, which made a search engine that could pore through emails and other internal business documents to help companies find vital information more quickly. Autonomy’s steady growth in its first decade resulted in Lynch being dubbed Britain’s Bill Gates and earning him one of the U.K’s highest honors, the Office of the Most Excellent Order of the British Empire in 2006.

Lynch, 59, sold Autonomy to Hewlett-Packard for $11 billion in 2011. But the deal quickly turned sour after he was accused of cooking the books to make the sale.

The fraud allegations resulting in Lynch being fired by HP’s then-CEO Meg Whitman and a decade-long legal battle. It culminated with him being extradited from the U.K. to face criminal charges of masterminding a multibillion-dollar fraud.

Lynch steadfastly denied any wrongdoing, asserting that he was being made a scapegoat for HP’s own bungling — a position he maintained while testifying before a jury during a 2 1/2 month trial in San Francisco earlier this year. U.S. Justice Department prosecutors called more than 30 witnesses in an attempt to prove their allegations against Lynch.

Lynch was vindicated at trial in June after being cleared of all charges. Lynch pledged to return to the U.K. and explore new ways to innovate.

Although he avoided a possible prison sentence, Lynch still faced a potentially huge bill stemming from a civil cased in London that HP mostly won in 2022. Damages haven’t been determined in that case, but HP is seeking $4 billion. Lynch made more than $800 million from the Autonomy sale.

Lynch later went on to set up technology investment firm Invoke Capital.

One of Lynch’s U.S. lawyers, Christopher Morvillo of the firm Clifford Chance, and his wife Neda were also on the yacht and are among those unaccounted for.

Morvillo is regarded as an elite defense attorney specializing in fraud and corruption cases. He was previously a federal prosecutor in New York who worked on the criminal investigation of the September 11, 2001 terrorist attacks. His father, Robert Morvillo, was also a lawyer who represented high-profile clients, including Martha Stewart.

In a LinkedIn post soon after Lynch’s acquittal, Morvillo paid tribute to the team of lawyers who worked on the case and also his wife and two daughters.

“None of this would have been possible without your love and support. I am so glad to be home,” he wrote. The post ended with the words: “And they all lived happily ever after….”

In a legal podcast released last week, Morvillo recounted his involvement with Lynch’s case, starting from when his firm was hired in November 2012.

He flew to London to meet Lynch on Thanksgiving weekend that year and assumed he would be gone for a week, Morvillo told the For the Defense podcast. Instead, Morvillo said he “spent a significant portion of the rest of my life bouncing back and forth between London and New York.”

The case has “covered one third of my career,” he said. “It has been a constant presence in my life for the last 12 years.”

Clifford Chance said it was “in shock and deeply saddened by this tragic incident” and that its thoughts are with Morvillo and his wife. “Our utmost priority is providing support to the family,” the firm said.

The chairman of Morgan Stanley’s London-based investment banking subsidiary, Jonathan Bloomer, and his wife, Judy, were also among the yacht’s missing.

Bloomer is non-executive chairman of both Morgan Stanley International, which covers markets outside the U.S., and the Hiscox Group, an insurer that does business on the Lloyd’s of London insurance marketplace.

Lynch appointed Bloomer to Autonomy’s board of directors in 2010, where he served as chairman of the audit committee at the time of the HP deal. Bloomer testified for the defense at Lynch’s trial.

Both Morgan Stanley and Hiscox said they were “deeply shocked and saddened” by the tragedy.

“Our thoughts are with all those affected, in particular the Bloomer family, as we all wait for further news from this terrible situation,” the bank said.

Aki Hussain, the group chief executive of Hiscox, said “our thoughts are with all those affected, in particular our chair, Jonathan Bloomer, and his wife Judy, who are among the missing, and with their family as they await further news from this terrible situation.”

In a strange coincidence, another former Autonomy executive who was acquitted alongside Lynch of the fraud charges died days before the sinking of the Bayesian.

Stephen Chamberlain “was fatally struck by a car on Saturday while out running,” his lawyer Gary Lincenberg said in a statement.

Chamberlain, formerly a vice-president of finance at the company, was accused of artificially inflating Autonomy’s revenues and making false and misleading statements to auditors, analysts and regulators.

He stood trial with Lynch, and was also found not guilty.

“He was a courageous man with unparalleled integrity. We deeply miss him,” Lincenberg said. “Steve fought successfully to clear his good name at trial earlier this year, and his good name now lives on through his wonderful family.”

Chamberlain “was a much-loved husband, father, son, brother and friend,” his family said in statement released through Cambridgeshire Police. “He was an amazing individual whose only goal in life was to help others in any way possible.”

Police said the driver, a 49-year-old woman, remained at the scene in the village of Stretham, England, and was assisting with the investigation.

One body had been recovered, and police divers were trying to reach the hull of the ship, which was resting at a depth of 50 meters (163 feet) off Porticello, near Palermo, where it had been anchored, rescue authorities said.

It had a crew of 10 people and 12 passengers, the Italian coast guard said. A sudden fierce storm had battered the area overnight, and struck the place precisely where the 56-meter (184-foot) British-flagged Bayesian had been moored.

“They were in the wrong place at the wrong time,” said Cocina, noting that another superyacht nearby wasn’t as badly damaged and helped rescue some of the 15 survivors, who included Lynch’s wife Angela Bacares.

The Bayesian was notable for its single 75-meter (246-feet) mast — one of the world’s tallest made of aluminum and which was lit up at night, just hours before it sank. Online charter sites listed it for rent for up to 195,000 euros (about $215,000) a week.

One of the survivors, identified as Charlotte Emsley, said she momentarily lost hold of her 1-year-old daughter Sofia in the water, but then managed to hold her up over the waves until a lifeboat inflated and they were both pulled to safety, Italian news agency ANSA reported, quoting the mother. The father, James Emsley, also survived, said Cocina.

Eight of the 15 people rescued and taken ashore at Porticello were hospitalized while the others were taken to a hotel. One body believed to be the cook was found near the wreck, but six others were unaccounted for and believed inside the hull, said Luca Cari, a spokesperson for the Italian fire rescue service.

Rescue crews located the vessel and deep-water police divers were trying to access the hull, Cari said. The operations, which were visible from shore, involved helicopters and rescue boats from the coast guard, fire rescue and civil protection service.

Fisherman Francesco Cefalu’ said he had seen a flare from shore at around 4:30 a.m. and immediately set out to the site but by the time he got there, the Bayesian had already sunk, with only cushions, wood and other items from the superyacht floating in the water.

“But for the rest, we didn’t find anyone,” he said from the port hours later. He said that he immediately alerted the coast guard and stayed on site for three hours, but didn’t find any survivors. “I think they are inside, all the missing people.”

He said he had been up early to check the weather to see if he could go fishing, and surmised that a sudden waterspout had struck the yacht.

“It could be that the mast broke, or the anchor at the prow pulled it, I don’t know,” he said.

Cocina said the crew and passengers hailed from a variety of countries: In addition to Britain and the United States, passengers and crew were from Antigua, France, Germany, Ireland, Myanmar, the Netherlands, New Zealand and Spain, he said.

British authorities said they were “providing consular support to a number of British nationals and their families.″ Dutch foreign ministry spokesperson Casper Soetekouw said the lone Dutch citizen on board, a man, had been rescued and was not in a life-threatening condition.

Lynch, once hailed as Britain’s king of technology, was cleared in June of fraud and conspiracy charges related to Hewlett Packard’s $11 billion takeover of his company, Autonomy Corp.

The not-guilty verdicts followed an 11-week criminal trial in San Francisco that delved into the history of HP’s 2011 acquisition of Autonomy, a business software firm founded by Lynch.

The fraud accusations represented a dramatic turn in the fortunes of an entrepreneur once described as the Bill Gates of Britain — a title he seemed to live up to when he netted an $800 million from the Autonomy sale.

The acquittal vindicated Lynch, who had vehemently denied wrong doing and portrayed HP as a technological train wreck.

“I’m looking forward to returning the UK and getting back to what I love most: my family and innovating in my field,” Lynch said in a statement released after the verdict.

The yacht, built in 2008 by the Italian firm Perini Navi, can accommodate 12 passengers in four double cabins, a triple and the master suite, plus crew accommodations, according to Charter World and Yacht Charters.

The vessel, which previously was named Salute when it flew under a Dutch flag, featured a sleek, minimalist interior of light wood with Japanese accents designed by the French designer Remi Tessier, according to descriptions and photos on the charter sites.
