Jeffrey ‍Epstein associate Ghislaine Maxwell’s deposition before the U.S. House Committee on Oversight and Government Reform has drawn significant attention due to her invoking the Fifth Amendment, refusing to answer any questions that could lead to self-incrimination.

Maxwell was found guilty in December 2021 of several charges related to her role in facilitating Epstein’s abuse of underage girls, and she is currently serving a 20-year prison sentence.

Here’s a brief overview of the Fifth Amendment Right and why it sparked the criticism from the political aisle in the U.S.

What is Fifth Amendment Right?

The Fifth Amendment to the U.S. Constitution is a legal protection that allows individuals to refuse to answer questions that could potentially incriminate them.

It offers key protections for individuals involved in legal cases, including safeguards against double jeopardy and the right to remain silent, which protects against self-incrimination.

Some of the key components of this right are as follows:

1. Grand jury indictment

It establishes that individuals cannot be charged with serious crimes (capital or infamous crimes) without a grand jury’s presentment or indictment.

2. Exceptions for military service

The amendment notes exceptions for cases arising in the land or naval forces, or in the militia, during times of war or public danger.

3. Double jeopardy

Double jeopardy prohibits an individual from being tried twice for the same offence after either an acquittal or a conviction. This protects individuals from the psychological and financial burdens of repeated trials for the same crime and ensures finality in legal proceedings.

4. Self-incrimination

The amendment protects individuals from being compelled to testify against themselves in criminal cases, often referred to as the right against self-incrimination.

5. Due process

The amendment guarantees that no person shall be deprived of life, liberty, or property without “due process of law.” This means that legal proceedings must be conducted fairly and in accordance with established rules and principles.

6. Just compensation for takings

It addresses the government’s power of eminent domain, stating that private property cannot be taken for public use without just compensation. If the government needs to acquire private property for public purposes (like building roads, schools, or parks), it must compensate the property owner fairly.

Why Ghislaine Maxwell pleaded the Fifth?

David Markus, representing Maxwell, has indicated that he advised her to invoke the Fifth Amendment in light of her ongoing habeas corpus petition.

However, the House Oversight Committee members point out that this was because she did not answer a single question. Although it’s legally permissible, the decision effectively curtailed a unique opportunity for the public to learn about Epstein’s activities from his closest confidante.

The Republican chairman, Rep. James Comer, faced increasing pressure to conduct the deposition, especially as he pushed for the enforcement of subpoenas against former President Bill Clinton and former Secretary of State Hillary Clinton.

After he threatened them with contempt of Congress charges, both of them agreed to participate in depositions later this month.

Elon Musk on Monday (February 2, 2026) denied any links to Jeffery Epstein, saying he never attended his parties or been on his “Lolita Express” plane or set foot on his creepy island or done anything wrong at all.

In a post on X, on Monday (February 2, 2026), Mr. Musk said, “I knew that I would be smeared relentlessly, despite never having attended his parties or been on his “Lolita Express” plane or set foot on his creepy island or done anything wrong at all.”

In the latest reveal on Friday (January 30, 2026), the newly released Epstein files mentioned high-profile figures, including U.S. President Donald Trump, forner US President Bill Clinton, English business magnate Richard Branson, Elon Musk, amid unverified allegations and connections

The files contain numerous mail exchanges between Epstein and Mr. Musk. In November 2012, the files show that Epstein sent Mr. Musk sent an email asking “how many people will you be for the heli to island.”

But it’s not immediately clear if the island visits took place.

In the post, Mr. Musk further said nobody has fought harder for full release of the Epstein files and prosecutions of those who abused children more than he did, knowing full well that the legacy media, far-left propagandists and those who are actually guilty would admit nothing, deny everything and make counter-accusations against him.

Mr. Musk also said the extreme pain of being accused of being the opposite of who he is was worth it.

The post said, “The strong must protect those cannot protect themselves, especially vulnerable children. I will gladly accept any amount of future pain to do more to protect kids and give them a chance to grow up and have happy lives.”

Two decades after Jeffrey Epstein was first reported to police, the Justice Department has started to release its investigative files on the late millionaire.

Indian filmmaker Mira Nair had attended an “after party” for a film at the townhouse of convicted sex trafficker Ghislaine Maxwell, according to the latest Epstein files released by the US Justice Department.

Ms. Nair, the mother of New York City Mayor Zohran Mamdani, is mentioned in one of the emails as part of additional files of investigation related to millionaire sex offender Jeffrey Epstein put out in public domain by the Department of Justice on Friday (January 30, 2026).

“Just left Ghislaine’s townhouse… after party for film. Bill Clinton and Jeff Bezos were there… Jean Pigozzi, director Mira Nair…etc. Film received tepid reaction although women like it much more… Hillary Swank and Gere at stupid party in Bloomingdales cheap sportwear department… very weird.

“Studio went for free party from store and windows for a month… Going to be in Wall Street 2 tomorrow…. more to come. xoxo Peg,” an email dated October 21, 2009 at 5:37:02 am by American publicist Peggy Siegal to an address ‘jeevacation@gmail.com’ said.

While the email does not mention the film’s name, it appears to be the 2009 film ‘Amelia’, directed by Ms. Nair and based on the life of legendary American pilot Amelia Earhart, who disappeared over the Pacific Ocean in 1937 during an attempt to circumnavigate the world. It starred Hillary Swank and Richard Gere.

PTI sent a message to Ms. Nair for a comment but has not received a response yet.

On Friday (January 30, 2026), the Department of Justice published over three million additional pages of the Epstein Files under the Epstein Files Transparency Act, which was signed into law by President Donald Trump on November 19, 2025.

More than 2,000 videos and 1,80,000 images are included in the additional publication. Combined with prior releases, this makes the total production nearly 3.5 million pages released, the department said.

The newly released files were collected from five primary sources, including the Florida and New York cases against Epstein, the New York case against Maxwell, the New York cases investigating Epstein’s death, the Florida case investigating a former butler of Epstein, multiple FBI investigations, and the Office of Inspector General investigation into Epstein’s death.

U.S. President Donald Trump on Sunday (November 16, 2025) urged his fellow Republicans in Congress to vote for the release of files related to the late convicted sex offender Jeffrey Epstein, reversing his earlier resistance to
such a move.

Mr. Trump’s post on his Truth Social came after House Speaker Mike Johnson said earlier that he believed a vote on releasing Justice Department documents in the Epstein case should help put to rest allegations that Mr. Trump had any connection to Epstein’s abuse and trafficking of underage girls.

“House Republicans should vote to release the Epstein files, because we have nothing to hide,” Mr. Trump wrote on Sunday night. “And it’s time to move on from this Democrat Hoax perpetrated by Radical Left Lunatics in order to deflect from the Great Success of the Republican Party, including our recent Victory on the Democrat ‘Shutdown’.”

Although Mr. Trump and Epstein were photographed together decades ago, the President has said the two men fell out before Epstein’s convictions. Emails released last week by a House committee showed the disgraced financier believed Mr. Trump “knew about the girls,” though it was not clear what that phrase meant. Mr. Trump, who has recently dismissed the Epstein files as a Democratic smear campaign, has since instructed the Department of Justice to investigate prominent Democrats’ ties to Epstein.

The battle over disclosure of more Epstein-related documents, a subject Mr. Trump himself campaigned on, has opened a rift with some of his allies in Congress.

Many of Mr. Trump’s most loyal supporters believe the government is withholding sensitive documents about Epstein, a convicted sex offender who died by suicide in jail in 2019, that would reveal the late financier’s ties to powerful public figures. Mr. Trump late on Friday (November 14, 2025) withdrew his support for U.S. Representative Marjorie Taylor Greene of Georgia, long one of his staunchest supporters in Congress, following her criticismnof Republicans on certain issues, including the handling of the Epstein files.

U.S. Representative Ro Khanna, a California Democrat and an original sponsor of the petition calling for a vote on the files’ release, said on Sunday that he expected more than 40 Republicans to vote in favor.

Republicans hold the majority in the House, with 219 seats, versus 214 for Democrats.
