A court case triggered the amendment, according to Law Ministry and EC officials

New Delhi:

The government has tweaked an election rule to prevent public inspection of certain electronic documents such as CCTV cameras, webcasting footage, and video recordings of candidates to prevent their misuse. This has led to the Opposition accusing the government of “eroding integrity of the electoral process”.

EC officials have said misuse of CCTV camera footage from inside polling booths could compromise voter secrecy. They also said the footage could be used to generate fake narrative using artificial intelligence (AI).

The Union Law Ministry on Friday amended Rule 93(2)(a) of the Conduct of Election Rules, 1961, to restrict the type of “papers” or documents open to public inspection, based on a recommendation by the Election Commission (EC).

According to Rule 93, all “papers” related to elections shall be open to public inspection. The amendment, however, inserts “as specified in these rules” after “papers”.

A court case triggered the amendment, according to Law Ministry and EC officials.

While documents such as nomination forms, appointment of election agents, results and election account statements are mentioned in the Conduct of Election Rules, electronic documents such as CCTV camera footage, webcasting footage and video recording of candidates during the model code period are not covered.

“CCTV coverage, webcasting of polling stations are not carried out under Conduct of Election Rules but are the result of steps taken by the EC to ensure a level playing field,” a former EC official told news agency PTI.

Another EC official said there have been instances where such electronic records have been sought, citing the rules. “The amendment ensures that only papers mentioned in the rules are available for public inspection and any other document which has no reference in the rules is not allowed for public inspection.”

All such material is still available to candidates, including footage, as people can always go to court to get electronic records, an EC official said, adding candidates already have access to all documents and papers and nothing has been amended in the rules in this regard.

The Punjab and Haryana High Court directed sharing all documents related to the Haryana assembly elections, including CCTV camera footage, with lawyer Mahmoud Pracha in a case he contested against the EC.

The rule mentioned only election papers, and election papers and documents do not specifically refer to electronic records. In order to remove this ambiguity, the rule has been amended to safeguard the misuse of CCTV camera footage from polling stations, an EC official said.

Congress general secretary in-charge communications Jairam Ramesh said the party will challenge the amendment in court.

“If there was ever a vindication of our assertions regarding the rapidly eroding integrity of the electoral process managed by the Election Commission of India (ECI) in recent times, this is it,” Mr Ramesh said in a post on X.

The Congress leader said sunlight was the best disinfectant and information would restore faith in the election process — a reasoning the Punjab and Haryana High Court agreed with when it directed the EC to share all information it was legally required to with the public.

Srinagar:

The Jammu and Kashmir Police on Wednesday released the photographs of two foreign terrorists involved in the Sunday terrorist attack on a workers’ camp in the Ganderbal district, leaving seven people dead and several others injured.

The photographs were developed from footage recorded by CCTV cameras installed inside the camp in Gagangir area in Ganderbal.

The police had said earlier that two foreign terrorists had entered the workers’ camp in the evening and fired indiscriminately at civilians. Seven people, including six non-local workers and a local doctor were killed in the attack, and four others were injured.

Investigators have already questioned over 40 people in connection with the terrorist attack. An NIA team, headed by a senior officer, also visited the terror attack site and had reportedly collected some vital clues from the terror attack site.

The workers were employees of APCO Infrastructure, which is building a tunnel from Z-Morh to Sonamarg tourist resort to make the Srinagar-Sonamarg road an all-weather road. After the tunnel becomes functional, Sonamarg will be an all-season tourist destination. This will help the local economy and also generate employment for the local youth.

The attack, coming shortly after Jammu and Kashmir got a new government, was widely condemned by Union Home Minister Amit Shah, Union Roads and Highways Minister Nitin Gadkari, Lt Governor Manoj Sinha, Chief Minister Omar Abdullah and former Chief Ministers Farooq Abdullah, Mehbooba Mufti, and Ghulam Nabi Azad.

The Lt Governor sanctioned ex gratia relief in favour of the Gagangir victim families while APCO Infrastructure released Rs 25 lakh as immediate relief for the families of the victims.

Hong Kong has close to 55,000public CCTV cameras, with plans to add 2,000 more this year.

Hong Kong’s police force is taking on a campaign to install thousands of surveillance cameras across the city to ramp up their crime-fighting capabilities. The Chinese city, consistently ranked among the world’s safest, plans to introduce facial recognition and artificial intelligence tools to enhance law enforcement. Critics, however, warn that this could come at the cost of privacy and freedom.

Hong Kong has close to 55,000 public CCTV cameras, with plans to add 2,000 more this year, announced security Chief Chris Tang in July. The police force is considering equipping these cameras with facial recognition technology and AI tools to help identify suspects. “The police will definitely comply with relevant laws,” said the force in a statement to CNN, though details on when these technologies might be deployed remain vague.

Experts are raising alarms about the repressive potential of surveillance technology, especially in Hong Kong. They draw parallels to mainland China’s extensive surveillance systems, highlighting the heightened concern in Hong Kong, where political dissent has been severely limited since the national security law was introduced after the 2019 anti-government protests.

Hong Kong already has more than 54,500 public CCTV cameras, equating to about seven cameras per 1,000 people. That number puts it on par with major cities like New York, though far behind China’s urban centres, where an average of 440 cameras per 1,000 people is commonplace.

Mr Tang highlighted that countries like the UK have also started using facial recognition cameras. However, experts warn that even in these democracies, the implementation of such technology has raised significant concerns about privacy.

Normann Witzleb, a professor at the Chinese University of Hong Kong, said, “It’s important to design guidelines for those systems that take proper recognition of the potential benefits that they have, but that also acknowledge they’re not foolproof, and that they have the potential to interfere with (people’s) rights in serious ways,” he said.

Steve Tsang, director of the SOAS China Institute, warned that the new cameras could be used for political repression under the guise of fighting crime. “This is likely to be a further step in making Hong Kong law enforcement closer to how it is done on the Chinese mainland,” he said.

Samantha Hoffman, a nonresident fellow at the National Bureau of Asian Research, noted, “The difference is how the technology is being used.” While Western democracies face their challenges with surveillance technology, she argues that the situation in Hong Kong is fundamentally different due to the legal framework supporting the government’s authority. She remarked, “When you feel like you’re being monitored, that affects your behaviour and your feelings of freedom,” as per CNN.

Two men standing nearby ran to help him after he collapsed.

A shocking video has emerged from Ghaziabad that shows a young man collapsing in a gym while running on a treadmill. The incident took place on Saturday in Saraswati Vihar. The victim, Siddharth Kumar Singh, experienced a sudden and fatal heart attack during his exercise routine. This is yet another case where a person has collapsed suddenly. A few months ago, one man died while waiting at the office of a property dealer, and another one collapsed during the dance at a wedding.

The moment in Ghaziabad has been captured on CCTV installed in the gym and shows Mr Singh stopping suddenly on the treadmill and slowly losing consciousness. Seconds later, he collapses on the machine.

Other concerned gym-goers rushed to help Mr Singh but couldn’t revive him.

The video also shows two men standing a few feet away from Mr Singh during the incident, and running quickly to pick him up after he fell on the treadmill.
