Delhi excise policy case: The trial court had ordered Mr Kejriwal’s release on a bond of Rs 1 lakh.

New Delhi:

The Aam Aadmi Party (AAP) will today challenge the Delhi High Court’s stay on the bail granted to Arvind Kejriwal in the Supreme Court. This decision comes after the trial court had previously granted bail to Mr Kejriwal on June 20 in connection with the alleged Delhi excise policy scam, only for the High Court to stay the bail order on Tuesday.

The trial court, in its June 20 decision, had ordered Mr Kejriwal’s release on a personal bond of Rs 1 lakh. However, a vacation bench of Justice Sudhir Kumar Jain of the Delhi High Court stayed the trial court’s order, criticising it for not adequately considering the material presented by the Enforcement Directorate (ED) and for not allowing the sufficient opportunity for the agency to argue its case.

High Court’s Criticism

Justice Jain remarked that the trial court had failed to properly evaluate the evidence against Mr Kejriwal presented by the ED. “We disagree with the Delhi High Court order. We will challenge it in the Supreme Court,” AAP said in a statement. 

Delhi Cabinet Minister Saurabh Bharadwaj, when asked about the High Court’s decision at a press conference, expressed skepticism and indicated that AAP’s legal team would strategise the next steps. “A High Court bench stayed the order of the lower court without even the order getting uploaded. I did not have any hope from the High Court. I think the High Court bench was prejudiced. We will approach the higher court,” Mr Bharadwaj said.

The Delhi excise policy, which was scrapped in 2022, has been under scrutiny following allegations of irregularities and corruption in its formulation and execution. Both the CBI and ED allege that undue favours were extended to license holders and that there were significant irregularities in the policy’s implementation.

AAP’s Response

Mr Kejriwal was questioned by the CBI in Tihar Jail on Monday and Tuesday, each session lasting over an hour.

AAP leader Sanjay Singh accused the BJP of conspiring with CBI officers to allegedly frame Mr Kejriwal in a “fake case.” In a video message, Mr Singh alleged that the BJP-led Centre was attempting to manipulate the legal process to target Mr Kejriwal.

“We have learnt from reliable sources that the BJP-led Centre has hatched a conspiracy with CBI officers at a time when there is a huge possibility of Kejriwal getting bail from the Supreme Court. They have planned to frame him in a fake case by the CBI and get him arrested. The entire country is watching the atrocities of the BJP. How will one get justice in such circumstances? People will stand up against this,” Mr Singh said.

The Enforcement Directorate or ED had arrested Arvind Kejriwal on March 21

Delhi Chief Minister Arvind Kejriwal was questioned by the Central Bureau of Investigation twice this week in the alleged liquor policy case. Mr Kejriwal was questioned on Monday by the central probe agency and then again on Tuesday in the Tihar jail for more than an hour.

The Aam Aadmi Party chief is currently in jail in connection with an Enforcement Directorate’s money laundering case arising from the alleged liquor policy case. The Delhi liquor policy 2021-22 was scrapped after the Delhi lieutenant governor ordered a CBI probe into alleged irregularities and corruption involving its formulation and execution.

The questioning of Mr Kejriwal comes just a day ahead of a Supreme Court hearing of the AAP petition against the Delhi High Court order staying the bail granted to the Chief Minister by a trial court.

The trial court had granted bail to Mr Kejriwal on June 20 and ordered his release on a personal bond of Rs 1 lakh. The high court stayed the trial court order on Tuesday, saying the Delhi’s Rouse Avenue Court – “didn’t apply its mind” when granting bail and pointed to what it said were lapses in judgement.

The AAP, meanwhile, alleged a conspiracy involving CBI officers to frame Mr Kejriwal in a “fake case” and get him arrested. The CBI has rejected the accusations.

The Enforcement Directorate or ED had arrested Mr Kejriwal on March 21, shortly after the Delhi High Court refused to grant him protection from arrest on his petition challenging summonses issued to him.

On May 10, the Supreme Court granted interim bail to Mr Kejriwal till June 1 to campaign in Lok Sabha elections, saying he will have to surrender and go back to jail on June 2. He has been in jail ever since.

The ED and the CBI have alleged the Delhi government’s liquor policy for 2021-22 allowed cartelisation and favoured certain dealers who paid bribes for licenses. The AAP has strongly denied the charge.

Arvind Kejriwal will remain in jail after the Delhi High Court, on Tuesday afternoon, upheld its interim stay on a lower court granting the Chief Minister regular bail in the alleged liquor policy case.

The High Court argued that the lower court – Delhi’s Rouse Avenue Court – “didn’t apply its mind” when granting bail and pointed to what it said were lapses in judgement. These included not giving the prosecution enough time to argue the application and failing to properly discuss conditions for release in the Prevention of Money Laundering Act, under which Mr Kejriwal was charged.

“Averments and allegations made in the main petition (in which the prosecution challenged Mr Kejriwal’s bail order) require due consideration…,” the High Court said, declaring the lower court had also failed to “discuss the vicarious liability of Arvind Kejriwal under Section 70 of the PMLA”.

“This court has (therefore) decided that the vacation judge (in the Rouse Avenue Court, Niyay Bindu) did not appropriately appreciate material on record and the averments of ED,” the High Court said.

“Accordingly, the application is allowed and operation of the impugned order is stayed.”

ED Had Moved High Court On Bail

The High Court had been approached last week by the Enforcement Directorate – the federal agency that arrested the AAP leader in March in connection with the liquor policy case. The ED filed a last-gasp petition challenging a city court’s regular bail order, which it called “perverse” and “flawed”.

The High Court heard both sides and then directed an interim stay on Mr Kejriwal’s release pending its full verdict today. On Monday Mr Kejriwal moved the Supreme Court against that interim stay.

The Supreme Court refused immediate relief to the Delhi Chief Minister, noting it would be improper for it to intervene when the High Court had reserved its judgement.

It did, however, admit the High Court’s actions were “unusual”; Justice Manoj Misra said, “In stay matters, orders are not reserved but passed on the spot. What has happened here is unusual.”

“Why Can’t I Be Free?” Kejriwal Argued

In the top court – which last month granted Mr Kejriwal interim bail so he could campaign for his party, and the Congress-led INDIA opposition bloc, in the general election – the AAP leader argued that the “balance of convenience” was in his favour. “If bail is reversed, he will go back to jail… as he did after the Supreme Court’s interim release,” senior advocate Abhishek Singhvi had said.

Mr Singhvi also referred to the top court’s order granting Mr Kejriwal that interim bail, in which it acknowledged the AAP leader is not a “habitual offender” and has no criminal antecedents.

“Why can’t I be free in the interim? I have a judgment in my favour…” he had asked.

Last Thursday Mr Kejriwal was given regular bail by the Rouse Avenue Court.

The court accepted his argument that the case against him rested only on statements from former accused who have since turned government witnesses. “Circumstances have to be so intrinsically linked (as to) lead to the guilt. Statements by tainted persons discredit prosecution’s case. There is no evidence Rs 100 crore came from ‘South Group’. There is no evidence,” he argued.

Why Was Mr Kejriwal Arrested?

The ED arrested Mr Kejriwal over money laundering allegations while framing the Delhi liquor policy for 2021-22, which was later scrapped after the Lieutenant Governor raised red flags.

The ED has alleged that the money Mr Kejriwal and the AAP got from the liquor sellers – around Rs 100 crore – was used to fund the party’s poll campaign in Goa and Punjab.

Both Mr Kejriwal and the AAP have rubbished the charges, calling them political vendetta and pointing out that despite months of searching the ED has still not found the alleged bribe money.

Delhi Chief Minister Arvind Kejriwal – on interim bail following his arrest in the alleged liquor policy scam – began his battle for regular bail Thursday afternoon in the city’s Rouse Avenue Court.

He has filed two pleas – for normal bail, and to extend the Supreme Court-ordered interim bail by a week, citing a battery of pending medical tests over potential “health complications” from his diabetes.

In the brief hearing that followed the Enforcement Directorate opposed both pleas. The federal agency sought at least two days to respond and took a swipe at the bail plea on health grounds.

The ED pointed out Mr Kejriwal – whom party sources told NDTV has led 67 rallies or roadshows and given 30 interviews since his release on interim bail – seemed to be in fine condition. The agency also seemed irked by the AAP leader filing his pleas a little over 48 hours before the bail period expires.

“He is not in custody… he is, today, in Punjab campaigning. His health does not hinder him from campaigning… and he moves bail on the last date so we get very little time (to argue),” the ED said.

“His conduct doesn’t entitle him for any orders today,” Additional Solicitor-General SV Raju, appearing for the central agency, told the court, which gave the ED time till 2 pm Saturday to respond.

The Rouse Avenue Court is also due to rule (on June 4, on counting day) on a point of cognisance on the ED’s supplementary chargesheet, which is linked to an associated money laundering case.

Mr Kejriwal has been singularly active since his release from jail, leading his party’s charge (and contributing to that of the Congress-led INDIA bloc) ahead of polling in Delhi and Punjab.

These are the states where the AAP is in power and send a combined 20 MPs to the Lok Sabha, but the curious case of the alliance with the Congress remains a point of interest. The parties are contesting together in Delhi but as rivals in Punjab, where state leaders have taken regular potshots at each other.

Meanwhile, Mr Kejriwal’s regular release plea today is key since it is the first time he has actively applied for bail. His interim release this month was ordered by the Supreme Court as it was hearing his challenge to the ED’s arrest. The court recognised him as an elected leader and not a habitual offender.

Mr Kejriwal’s interim bail expires June 1, or on completion of polling for the final phase of the Lok Sabha election. He is to report to Delhi’s Tihar Jail authorities 24 hours after that, i.e., June 2. On Tuesday he asked the top court to extend his freedom by seven days so he could finish the tests.

However, the court refused an urgent hearing and also seemed put out by the timing.

It was pointed out the plea could have been filed last week, when Justice Datta – part of the bench that granted interim bail – was hearing cases. “Why did you not mention this (then)…?” the court asked.

Mr Kejriwal was, though, given leave to move the lower court at this time, which he did this afternoon.

In earlier arguments Mr Kejriwal had underlined the row between himself and jail authorities over the supply of insulin. His AAP had claimed he was deliberately deprived of the “life-saving” drug.

That row also reached the courts after Arvind Kejriwal criticised Tihar jail and ED officials for being “petty” and “politicising” his well-being. The probe agency responded by claiming the Chief Minister had deliberately consumed foods high in sugar – like mangoes and toffees, in alleged violation of a prescribed diet chart – to place his health at risk and establish grounds for medical bail.

“My health condition is due partly to the insensitive behaviour of the prison authorities. One more week of bail will allow me to take stock of (possible) health complications,” he had argued.

The Supreme Court will not hear Arvind Kejriwal’s request seeking a 7-day extension of his interim bail in a corruption case linked to the Delhi liquor policy. The Court last month granted interim bail to Mr Kejriwal to campaign for the Lok Sabha elections and had asked him to surrender on June 2, a day after the last leg of polling.

The Supreme Court registrar, while refusing the plea, said that the Delhi Chief Minister was given permission to move trial court for regular bail, and hence this petition is “not maintainable”.

Mr Kejriwal had sought an extension on medical ground and requested the court for an urgent hearing today.

“In view of health complications and increased risk signs, a medical examination is necessary to protect him from possible long-term harm to during his prison term,” senior advocate Abhishek Manu Singhvi, who is representing Mr Kejriwal, said in the petition. He had also stressed that the AAP leader will remain “visible and available in public” while out on bail.

“There is no risk of fleeing the legal process and conditions set by Supreme Court (for interim bail) have been followed…” Mr Singhvi said.

The probe agency believes the Delhi Chief Minister played a key role in drafting the now-scrapped policy and seeking bribes, or kickbacks, in return for liquor licences. The agency has claimed the AAP received kickbacks of Rs 100 crore that was then used to fund its Goa and Punjab election campaigns.

The AAP and Mr Kejriwal have refused all charges and called the arrest and case “political vendetta”, coming as it did, weeks before the election. The arrest also triggered a political spat between the ruling BJP and the opposition INDIA bloc, which is led by the Congress and of which the AAP is a member.

Mr Kejriwal, the national convenor of the Aam Aadmi Party (AAP), was arrested on March 21 by the Enforcement Directorate (ED) in a money laundering case linked to the alleged liquor policy scam. He is currently lodged in Tihar jail under judicial custody.

Earlier Tuesday, a Delhi court extended his judicial custody till May 20.

Arvind Kejriwal Live: What ED Said On Arvind Kejriwal’s Bail

The ED, in its affidavit in Supreme Court, repeated an argument it had made during the last Supreme Court hearing and said that campaigning is part of a politician’s job and, following the rule of equality, small farmers or small traders can also seek interim bail to carry out the demands of their work. 

It also stressed that Arvind Kejriwal is not even contesting the ongoing Lok Sabha elections.

The central agency said that granting bail to the AAP chief would set a precedent that would permit “all unscrupulous politicians” to commit crimes and then evade investigation citing campaigning for one election or the other.

Arvind Kejriwal’s Interim Bail Live: Probe Agency’s Affidavit In Supreme Court

In its affidavit filed in the Supreme Court on Thursday, the ED pointed out that, while hearing the bail plea of former Delhi deputy chief minister Manish Sisodia — a co-accused in the same Delhi liquor policy case — the court had said that the laws apply equally to all citizens and institutions, including the State.

Stating that Arvind Kejriwal had sought interim bail primarily for campaigning in the Lok Sabha elections, the agency submitted, “It is relevant to note that the right to campaign is neither a fundamental right nor a constitutional right and not even a legal right.”

The agency also argued that 123 elections have taken place in the past five years and if interim bail is granted to Mr Kejriwal for campaigning, then no politician can be kept in judicial custody since polls take place around the year.

The probe agency ED has filed an affidavit in the Supreme Court opposing Arvind Kejriwal’s petition. It said that laws are equal for all and that campaigning for the Lok Sabha polls is not a fundamental, constitutional, or even a legal right.

The central agency also said that no political leader has ever been granted bail for campaigning and that letting Mr Kejriwal, the national convenor of the Aam Aadmi Party (AAP), out of jail to canvas for his party candidates would set a wrong precedent.

The Supreme Court will deliberate today on whether to grant interim bail to Delhi Chief Minister Arvind Kejriwal, who has been under arrest since March 21 and is currently confined in Tihar jail under judicial custody, in connection with a money laundering case linked to the scrapped Delhi excise policy. 

A bench comprising Justices Sanjiv Khanna and Dipankar Datta will begin proceedings by considering the plea of the Aam Aadmi Party (AAP) leader.  The Supreme Court on May 3, hinted at the possibility of granting interim bail to Mr Kejriwal in light of the ongoing Lok Sabha elections. Acknowledging the potentially time-consuming nature of the legal proceedings, the court expressed its willingness to hear arguments from the Enforcement Directorate (ED) regarding interim relief to the AAP chief before elections in Delhi that are scheduled for May 25.

During the previous hearing, Additional Solicitor General SV Raju, representing the ED, expressed opposition to Mr Kejriwal’s bail, citing statements made by AAP leader Sanjay Singh following his release on bail in a related case. 

“We are not commenting on it either way. We are just saying we will hear on interim bail and not saying we will grant interim bail. We may or may not grant interim bail,” the Supreme Court had said.

The bench also raised questions regarding Mr Kejriwal’s official duties, particularly in relation to signing official documents, given his current legal predicament. 

Additionally, fresh controversy erupted after Delhi Lieutenant Governor VK Saxena recommended a National Investigation Agency (NIA) probe against Mr Kejriwal, alleging political funding from the banned group ‘Sikhs for Justice.’

In response, AAP leaders denounced the LG’s recommendation as yet another political ploy orchestrated by the Bharatiya Janata Party (BJP) to tarnish Mr Kejriwal’s image.
