New Telecom Rules That Strengthen Centre’s Control To Be Effective Partially From Today

Telecommunications Act 2023 also protects users from spam and malicious communications

These include rules that allow the government to take over the control and management of any or all of any telecommunication services or network, in the interest of national security, friendly relations with foreign states, or in the event of war.

The government has said the entire law is based on principles of inclusion, security, growth and responsiveness to achieve the vision of developed India.

The Telecommunications Act, 2023, was passed by parliament in December 2023. It received the President’s assent on December 24, 2023 and was notified the same day.

“Guided by the principles of Samavesh (Inclusion), Suraksha (Security), Vriddhi (Growth), and Tvarit (Responsiveness), the Act aims to achieve the vision of Viksit Bharat (Developed India),” the government said in a statement last week.

With these new rules in effect, the universal service obligation fund will become Digital Bharat Nidhi, which can be used for funding research and development, and pilot projects instead of just supporting the establishment of telecom services in rural areas.

The new rules also add a mandate of protecting users from spam and malicious communications.

The Telecommunications Act, 2023 is aimed at repealing existing legislative frameworks like Indian Telegraph Act, 1885 and Indian Wireless Telegraph Act, 1933 owing to huge technical advancements in the telecom sector and technologies.

The rules pave the way for enforcement of non-discriminatory and non-exclusive grants of right of way for telecom network roll-out and give power to the central government to set up common ducts and cable corridors, the Centre has said.

Chief Justice DY Chandrachud On “Ideological Framework” Of New Criminal Laws

The Chief Justice of India, Justice DY Chandrachud, on Saturday said that “the newly enacted criminal laws have transitioned India’s legal framework on criminal justice into the new age.”

Addressing a conference on India’s Criminal Justice System organised by the Ministry of Law and Justice, he said that much-needed improvements have been introduced to protect victim interests and carry out the investigation and prosecution of offences efficiently.

“India is set for a significant overhaul of its criminal justice system with the upcoming implementation of three new criminal laws. The Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita, and Bharatiya Sakshya Adhiniyam will replace the Indian Penal Code 1860, the Code of Criminal Procedure 1973 and the Indian Evidence Act 1872, respectively. These laws signify a watershed moment for our society because no law affects the day-to-day conduct of our society like the criminal law,” he said.

Criminal law directs the moral arc of a nation. The underlying justification for the substantive provisions is the age-old harm principle, which is best summarised in the saying, ‘Your right to swing your arms ends just where the other man’s nose begins. Procedural law, which governs crimes from the state of setting the criminal process in motion to the conviction for the commission of the offence, ensures that no person is charged and subsequently convicted for offences without due process of law, he added.

While addressing the Conference on India’s Progressive Path in the Administration of the Criminal Justice System, Chief Justice Chandrachud said, “Our laws and their implementation are an ever-evolving area. There is no finality to any law or the manner of its implementation. However, we must be willing to embrace positive changes to meet the needs of our times.”

“I expect that with the implementation of the new criminal laws, we will discover loopholes and areas that need to be addressed. Such debates would be helpful in enhancing the efficiency of our criminal justice systems. However, the ideological framework at the heart of our analysis must be justice-oriented with a civil liberty-centric approach that balances the interests of the victim and the accused,” he added.

“Our laws need to address these concerns and obviate age-old issues like delays in examination of witnesses, conclusion of trials, overcrowding of prisons and the issue of undertrial prisoners,” he said.

The 248th Report of the Standing Committee of the Rajya Sabha on the Bharatiya Sakshya Samhita of November 10, 2023, noted that the Indian criminal justice system has struggled to keep pace with the profound technological changes our socio-economic milieu that have radically re-imagined the way in which crimes manifest in society.

The growing scope of technology and new-age crime, which use the digital landscape to create networks of collaborative units to commit crimes, cannot be pinned to investigative situations. This has presented challenges in the investigation of crimes, admission of evidence, prosecution, and delivery of justice, he said.

As the distinguished American jurist Justice Oliver Wendell Holmes said in “Law in Science–Science in Law”, that “everyone instinctively recognises that in these days, the justification of a law for us cannot be found in the fact that our fathers have always followed it. It must be found in some help that the law brings towards reaching a social end that the governing power of the community has made up its mind that it wants,” he added.

The three laws, ie, the Bharatiya Nyaya Sanhita, 2023; the Bharatiya Nagarik Suraksha Sanhita, 2023; and the Bharatiya Sakshya Adhiniyam, 2023, replace the earlier criminal laws, namely, the Indian Penal Code 1860, the Code of Criminal Procedure, 1973 and the Indian Evidence Act, 1872. As notified, these criminal laws are to take effect from July 1.

Other dignitaries who attended the conference include Arjun Ram Meghwal, Minister of State (independent charge) for the Ministry of Law and Justice, R Venkataramani, Attorney General for India, Tushar Mehta, Solicitor General of India, Rajiv Mani, Law Secretary, Government of India, among others.

The conference aims to bring out the highlights of the three criminal laws and organise meaningful interactions through technical and question-and-answer sessions. Besides, judges of various courts, advocates, academicians, representatives of law enforcement agencies, police officials, public prosecutors, district administration officials and law students also participated in the conference.

The departure of Warner did not deter Marsh who continued his onslaught and was accompanied by Steven Smith who was at his usual best. Thanks to Marsh’s 96 and Smith’s 74, Australia found themselves in a position of strength where 400 was a possible total. After Smith’s dismissal, the visitors were not able to continue the momentum and kept losing wickets at regular intervals. Marnus was unperturbed by what was happening at the other end and ensured Australia had enough on the board before being dismissed in the penultimate over. For India, Jasprit Bumrah was taken to the cleaners in the first overs but fought back to finish with 3 wickets.

In pursuit of what was a daunting total, India needed to get off the blocks quickly to stay ahead in the game. Rohit Sharma was as effortless as ever and provided his side with a dream start in the run chase. His new opening partner Washington Sundar wasn’t as fluent but hung in there to offer good support to his skipper. Rohit then began to take the innings forward with Virat Kohli and the experienced duo ensured that the Indian innings did not lose steam. However, as the ball got softer, shot-making became tough nor were they able to rotate the strike. Rohit was dismissed on 81 while Kohli succumbed to the scoreboard pressure and departed shortly after reaching his fifty. It all went downhill for India post that as KL Rahul, Shreyas Iyer, and Suryakumar Yadav perished in their quest to up the ante. With the required run rate climbing with each ball and not much batting depth, it eventually proved to be a bridge too far for India.

Despite falling 20-25 runs short of where they would have wanted to be, Australia had a massive total on the board. As has been the case in the first two ODIs, the pacers lacked the cutting edge with the new ball and were guilty of bowling too short which allowed Rohit Sharma in particular to get going. As he has so often done, Glenn Maxwell delivered the goods for Australia by breaking the opening stand. He bowled with exceptional control in the middle phase and helped Australia tighten the screws. Maxwell piled more misery on India with the wickets of Rohit and Kohli and never allowed India to come back into the game. The rest of the bowlers chipped in as well with the pacers taking pace off constantly to keep the batters guessing. Glenn Maxwell registered his career-best figures of 4 for 40 and turned the game in Australia’s way.

A comprehensive victory for Australia in the third and final ODI! They have emerged victorious in Rajkot with a convincing margin of 66 runs. By doing so, they have avoided the whitewash and this win will put them in good stead ahead of the ODI World Cup. Thanks to the dominant performances in the first two games, it is India who have clinched the series with a 2-1 scoreline.
