Mamata Banerjee needs to win the Bhabanipur by-poll as an MLA to retain the Chief Minister’s post. The results will be out on October 3.
The Calcutta High Court ordered that Bhabanipur bypoll willcontinue. The HC dismissed a plea against the bypoll. The court supported the bypoll as scheduled.
However, the WB chief secretary commented on the order passed by the HC today. For using the term “constitutional crisis” in his letter to the EC.
The order said that the court records strong reservations about the performance of the Chief Secretary in writing to EC. It states that there would be a ‘constitutional crisis’ in case a by-poll to the Bhabanipur Constituency is not accomplished. He is a public servant, and discharged his duties in terms of provisions of law, whosoever may be in office. He is not to assure that any particular person should come in power and in the absence there would be a ‘constitutional crisis’.
As per HC, one person not nominated til now will not create any constitutional crisis as any other elected member of the Assembly can be sworn in as leader of the party and consequently, the Chief Minister.
A PIL had asked the EC’s contention of a “constitutional exigency” for holding by-poll to Bhabanipur assembly seat in Kolkata.
The EC said the petitioner is attempting to confuse the meaning of the term constitutional exigency. Focusing that the same does not mean an attempt to influence voters.
The WB government placed before the court that the chief secretary had written to the Commission about the by-election be held.
Bypoll to Bhawanipur seat is stipulated following the resignation of TMC MLA Sovandeb to help party supremo’s election to the assembly.

Mamata will be contesting against BJP’s Priyanka Tibrewal, a 41-year-old Calcutta HC lawyer.
Ms Banerjee, took charge as CM for the third time after the TMC’s mega victory in the state election. She needs to win the Bhawanipur by-poll as an MLA to retain the key post. The results will be on October 3.
A person nominated to the legislature within six months for taking oath in office.
Mamata Banerjee had lost to BJP’s Suvendu Adhikari in Nandigram in the March-April Assembly elections.
The Bhawanipur bypoll is extremely critical for the BJP.
